Terms of Service for DancingEcard.com

1. ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS OF SERVICE.

DancingEcard.com(“DancingEcard”) is owned and operated by Alejandro Bonillas (“Owner”)  and is provided to you (“User”) under the terms and conditions of  this  DancingEcard.com Terms of Service (“FTS”). When you complete the registration process for a  DancingEcard account, you are indicating your agreement to  the terms and conditions of the FTS. 2. DESCRIPTION OF SERVICE

DancingEcard provides User with various publishing, broadcasting and community services, like the capability to post information on a web page and others.  These services are by the moment free of charge, but some or all services may at any time require a payment fee. If this happens, user will be informed of these payment changes before his next account login. This next part is quite obvious, but  in order to use DancingEcard’s services, user must provide all equipment  necessary to establish a connection to the World Wide Web like a computer and modem , and user must also provide for own access to the World Wide Web and pay any telephone service fees associated with such access.

3. MODIFICATIONS TO TERMS OF SERVICE

Owner may change the terms and conditions of the FTS at anytime with or without notification to User. If Owner does some kind of major change to the FTS, Owner will notify User by posting the changes as a start-up screen prior to you next DancingEcard.com account login.

4. MODIFICATIONS TO SERVICE

Owner has the right to modify and/or discontinue the Service with or without notice to User. Owner will not be liable to User or any third party if the service is discontinued or modified.

5. PRIVACY POLICY

All information entered into DancingEcard by User except for password  may be made public. All information entered  into the DancingEcard  profile administration page will be accessible to the public through the User’s DancingEcard site

6. USER CONDUCT

All information data, text, software, music, sound photographs, graphics, video, messages or any other Material (“Content”) are the sole responsibility of the person from which such Content originated. This means that you, not the Owner nor DancingEcard, are responsible for all Content you upload, post or otherwise transmit through the service. You also understand that using the service, you may be exposed to Content that is offensive, objectionable or indecent.

You may NOT use the service to :

1. Upload, post or transmit  any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, invasive , hateful, racial or objectionable.
2. Harm any person in any way
3. Impersonate any person or entity
4. Upload, post or transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships.
5. Upload, post or transmit any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights or any party
6. Upload post or transmit software viruses or any computer code files or programs that may interrupt, destroy or limit the functionality of any computer software, hardware or telecommunications
7. Interfere with or disrupt any service or service connected to DancingEcard.
8. Violate any local, state national or international law.
9. Promote illegal activities, physical harm or injury against any group,person or animal.

7. CONTENT SUBMITTED TO DancingEcard

Owner does not claim ownership to any content you place on your DancingEcard Site. Owner may quote or reproduce small portions of your content  in order to promote your DancingEcard site and/or the DancingEcard service.

Owner shall delete all your DancingEcard site content that is 4 months old. Owner is not responsible for the content you upload. Owner has the right to refuse or remove any Content that is available via the Service. Owner has the right to refuse or remove any Content that violates the FTS or is otherwise objectionable. In fact, Owner has the right to remove any content at any time.

8. STORAGE AND OTHER LIMITATIONS

Owner  assumes no responsibility for the deletion or failure to store information entered into DancingEcard.

Owner has a set fixed upper limit on the number of Content User may publish through the Service or the amount of storage . This number is 25 megs of storage and this storage limit will be changed by Owner whenever Owner feels like it, to whatever limit Owner wants.

9. INDEMNITY

You agree to indemnify and hold Owner harmless from any claim or demand made by any third party due to  your Content, your use of the DancingEcard Service, your connection to the DancingEcard Service, your violation of the FTS, or your violation of any rights of another.

10. USER ACCOUNT, PASSWORD, AND SECURITY

When you become a member of DancingEcard, you receive a password and an account. You are entirely responsible if you do not maintain the confidentiality of your password and account. You are also entirely responsible for all activities that occur under your account.

11. MODIFICATIONS TO SERVICE

Owner reserves the right at any time and† from time to time to modify or discontinue, temporarily or† permanently, the DancingEcard Service with or without notice.† You agree that DancingEcard shall not be liable to you or to any third party† for any modification, suspension or discontinuance of the Service.

12. TERMINATION

Owner, in its sole discretion, may† terminate your password, DancingEcard Site, use of the DancingEcard Service or use of† any other Owner service, and remove and discard any Content within the DancingEcard Service, for any reason, including, without limitation, for lack of† use or if Owner believes that you have violated or acted inconsistently† with the FTS.

13. DISCLAIMER OF WARRANTIES YOU EXPRESSLY UNDERSTAND AND AGREE THAT  YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS  PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

 14. LIMITATION OF LIABILITY YOU EXPRESSLY UNDERSTAND AND AGREE THAT  Owner SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL,  SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED  TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER  INTANGIBLE LOSSES RESULTING FROM THE USE OR THE INABILITY TO USE THE  SERVICE OR ANY OTHER.
